Supply of Alcohol
1. No supply of alcohol may be made under this licence: A) At a time when there is no designated premises supervisor in respect of it, or B) At a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended. 2. Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence. 3. (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises— (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to— (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective; (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective; (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti- social behaviour or to refer to the effects of drunkenness in any favourable manner; (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability). 4. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available. 5. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either— (a) a holographic mark, or (b) an ultraviolet feature. 6. The responsible person must ensure that— (a)where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures— (i) beer or cider: ½ pint; (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii)still wine in a glass: 125 ml; (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and (c)where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available. 7. Any individual carrying out security activities at the premises must be licensed by the Security Industry Authority. 8. 10. 1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2) For the purposes of the condition set out in paragraph 1— (a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b)“permitted price” is the price found by applying the formula— . P=D + (DxV) where— (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence— (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994. 3) Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4) (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
General
The premises will be professionally managed by experienced licence holders with a commitment to promoting all four licensing objectives at all times. Staff will receive appropriate induction and ongoing training in licensing law, responsible alcohol retailing, safeguarding, conflict management and customer care. Written operating procedures will be maintained and reviewed regularly. The premises will operate CCTV, Challenge 25, incident and refusals registers, and maintain effective communication with Warwickshire Police, Warwick District Council and other responsible authorities where appropriate.
Prevention of Crime & Disorder
A comprehensive digital CCTV system shall operate throughout the premises, including all customer areas, entrances and exits, with recordings retained for a minimum of 31 days and made available to Police or authorised officers upon request. Challenge 25 will operate at all times, with acceptable photographic identification required where appropriate. An incident and refusals register will be maintained. Staff will receive training in responsible alcohol sales, conflict management and recognising vulnerable persons. Any door supervision employed will be SIA registered.
Public Safety
The premises will comply with all relevant fire safety, health and safety and food hygiene legislation. Staff will receive training in emergency procedures, evacuation and first aid awareness. Occupancy levels will be monitored to ensure safe operation. Fire detection and emergency lighting systems will be regularly maintained and tested. The premises will be kept clean, well maintained and free from hazards, with regular inspections undertaken throughout trading hours.
Prevention of Public Nuisance
The premises will be managed to minimise disturbance to neighbouring properties. No dedicated bass speakers or subwoofers will be used within the external courtyard, and any amplified music in the courtyard will cease by 23:00. Sound levels will be actively monitored by management throughout trading, with music maintained at an appropriate level having regard to neighbouring properties. Where appropriate, sound level monitoring equipment may be used to assist management in controlling noise. Doors and windows will be managed appropriately during regulated entertainment where necessary. Staff and, where employed, SIA door supervisors will encourage customers to leave quietly and will actively manage customer dispersal at closing time. Signage requesting patrons to respect neighbouring residents will be displayed at exits. Deliveries, waste collections and bottle disposal will be undertaken at reasonable times to minimise disturbance. Management will respond promptly and positively to any concerns raised by neighbouring residents or responsible authorities.
Protection of Children
Challenge 25 will operate at all times, with only valid photographic identification accepted as proof of age. Staff will receive regular training regarding underage sales, safeguarding and the protection of vulnerable persons. Children under the age of 16 will be permitted on the premises only when accompanied by a responsible adult unless attending a pre-booked private function. Any entertainment or promotional activities will be appropriate for a family-friendly hospitality environment. The premises will not provide adult entertainment or activities unsuitable for children.
Conditions agreed with the Licensee
Conditions agreed with the Licensee 1. All staff to be trained in the prevention of underage sales to a level commensurate with their duties. 2. All such training to be updated as necessary for instance when legislation changes and should include training on how to deal with difficult customers. 3. The training should be clearly documented and shall be available. 4. Premises DPS or management must attend any invited training sessions held by responsible authorities on reasonable request. 5. An incident log must be kept at the premises, and made immediately available on request to an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or the Police, which must record the following: (a) all crimes reported to the venue (b) all ejections of patrons (c) any complaints received (d) any incidents of disorder (e) seizures of drugs or offensive weapons (f) any faults in the CCTV system or searching equipment or scanning equipment (g) any refusal of the sale of alcohol (h) any visit by a relevant authority or emergency service. 6. Any door supervisors will be SIA accredited and shall be employed as a minimum on Friday and Saturdays from 2100hours to closing time, unless agreed in writing with Warwickshire Police. 7. The Applicant shall ensure that CCTV is installed to the current British Standard and maintained to the satisfaction of the Police and Licensing Officers and shall ensure:- (a) All equipment shall have constant time/date generation. (b) This shall include a system to ensure automatic update in relation to the beginning and end of British Summer Time etc. (c) If the system is not capable of achieving this requirement the Licence holder or a nominated person must ensure that a manual facility is available to carry out this update as an alternative. (d) Recordings must be kept for a minimum of 31 days. (e) Recordings of incidents at the premises must be made secure for inspection by the Police and or Licensing Officers. (f) Copies of recordings will be made available to officers of the responsible authorities on reasonable request. (g) Unauthorised persons should not be allowed access to the system or view personal data as it could contravene the Data Protection Act or jeopardise any criminal investigation. (h) Arrangements for its repair must be made without delay, if the CCTV system becomes defective. 8. Operate a 'Challenge 25' age verification policy requiring proof of age by passport, photo driving licence or PASS accredited card. Display Challenge 25 material as a reminder to staff, as well as customers. 9. The premises licence holder (or his/her nominees) shall ensure that any patrons drinking and/or smoking outside the premises do so in an orderly manner and are supervised by staff to ensure that there is no public nuisance or obstruction of the public highway. 10. All outside areas to close at 23:00 except on a Friday and Saturday when the area is to close at 00:00. 11. No open vessels of alcohol to be removed from the premises at any time with the exception of the area defined within a valid pavement licence. 12. All external doors and windows shall be kept closed when regulated entertainment is being provided, except for access and egress and in the event of an emergency. During these times, the licence holder or his representative shall conduct regular assessments of the noise coming from the premises and shall take steps to reduce the level of noise where it is likely to cause disturbance to residents. A written record shall be made of these assessments in a logbook. This record must be kept on the premises and made available for inspection by a responsible authority on reasonable request. 13. A prompt or reminder to staff, at the point of sale, to consider whether a sale or challenge ought to be made - this could be a Challenge 25 poster at the bar/till - and Challenge 25 signage in the premise.
