Supply of Alcohol
1. No supply of alcohol may be made under this licence: A) At a time when there is no designated premises supervisor in respect of it, or B) At a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended. 2. Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence. 2. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either— (a) a holographic mark, or (b) an ultraviolet feature. 3. 1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2) For the purposes of the condition set out in paragraph 1— (a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b)“permitted price” is the price found by applying the formula— . P=D + (DxV) where— (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence— (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994. 3) Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4) (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
General
All staff will receive training on licensing laws and responsible alcohol sales. A designated premises supervisor will be on duty or available. CCTV will be installed and maintained. Staff will cooperate with the police, local authority and other responsible authorities. Incident and refusals logs will be kept and reviewed regularly.
Prevention of Crime & Disorder
CCTV covering all public areas. Challenge 25 policy to prevent underage sales. Staff trained to refuse service to intoxicated customers incident and refusals register maintained. Police contacted if necessary.
Public Safety
Fire safety equipment maintained and emergency exit kept clear. First aid kit available. Premises cleaned regularly to avoid hazard. Maximum occupancy not exceeded. Staff trained in emergency procedures.
Prevention of Public Nuisance
Customers asked to leave quietly. Door and windows kept closed where appropriate to reduce noise. Rubbish disposed of properly and at suitable times.
Protection of Children
Challenge 25 policy operated. No alcohol sold to anyone under 18. Staff trained to check ID. Children supervised by a responsible adult where appropriate
Conditions agreed with the Licensee
Conditions agreed with the Licensee 1. All staff to be trained in the prevention of underage sales to a level commensurate with their duties. 2. All such training to be updated as necessary for instance when legislation changes and should include training on how to deal with difficult customers and also recognition of safeguarding concerns and how to respond to them. 3. The training should be clearly documented and shall be available for inspection on request by an authorised officer of a responsible authority including an officer of the Police. 4. A Challenge 25 scheme shall be adopted and implemented. Photographic identification shall be requested before any alcohol is sold to any person who appears to be under 25 years of age. Acceptable proof of age shall include identification bearing the customers photograph, date of birth and integral holographic mark or security measure. Suitable means of identification would include PASS approved proof of age card, photo-card driving licence and passport. 5. An incident log must be kept at the premises, and made immediately available on request to an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or the Police, which must record the following: a) all crimes reported to the venue b) all ejections of patrons c) any complaints received d) any incidents of disorder e) seizures of drugs or offensive weapons f) any faults in the CCTV system or searching equipment or scanning equipment g) any refusal of the sale of alcohol h) any visit by a relevant authority or emergency service. This log shall be made available to the Police or Authorised Officers on request. 6. The Applicant shall ensure that CCTV is installed, covering all areas where licensable activity takes place, to the current British Standard and maintained to the satisfaction of the Police and Licensing Officers and shall ensure :- a) All equipment shall have constant time/date generation. b). This shall include a system to ensure automatic update in relation to the beginning and end of British Summer Time etc. c) If the system is not capable of achieving this requirement the Licence holder or a nominated person must ensure that a manual facility is available to carry out this update as an alternative. d) Recordings must be kept for a minimum of 31 days. e) Recordings of incidents at the premises must be made secure for inspection by the Police and or Licensing Officers. f) Copies of recordings will be made available to officers of the responsible authorities on reasonable request. g) Unauthorised persons should not be allowed access to the system or view personal data as it could contravene the Data Protection Act or jeopardise any criminal investigation. h) Arrangements for its repair must be made without delay, if the CCTV system becomes defective. 7. Alcohol displays to be screened off after 0000hrs. 8. A prompt or reminder to staff, at the point of sale, to consider whether a sale or challenge ought to be made - this could be a Challenge 25 poster at the bar/till - and Challenge 25 signage in the premise.
